1. Today when the matter is taken up for hearing, learned counsel for the
appellant represented that the matter has been settled out of the Court
between both the parties and he further represented that the appeal has
become "infructuous".
2. The representation made by the learned counsel for the appellant is
recorded.
3. Accordingly, the Appeal Suit is dismissed as infructuous. There shall be
no order as to costs.
