Learned counsel for the petitioner contends that the trial Court has not recorded reasons while directing the petitioner to deposit 20% of the compensation amount.

In support of his contentions, the learned counsel for the petitioner placed reliance on the judgment in RAKESH RANJAN SHRIVASTAVA Vs. THE STATE OF JHARKHAND & ANOHER.

Without expressing any opinion on the

SL. DATE ORDER OFFICE NO. NOTE said contentions raised, this Court views that an opportunity to be given to the petitioner to appreciate the contentions. It seems that despite the direction given by the trial Court to deposit the amount within 60 days, the petitioner has not deposited the said amount.

Learned counsel for the petitioner further submits that though he approached this Court within the time, the petition could not reach due to summer vacation.

Considering the submissions made, there shall be interim suspension of order dated 29.02.2024, in Crl.M.P.No.329 of 2023 in C.C.No.594 of 2018 on condition of his depositing Rs.2,00,000/- (Rupees two lakhs only) to the complainant within a period of four (4) weeks from the date of receipt of a copy of this order. In default of deposit of said amount as ordered supra, the interim suspension granted today would automatically stands vacated.

It is further directed that the petitioner herein shall file a memo with an undertaking to deposit the said amount to the
