This is an application seeking condonation of delay of 141 days in preferring the present appeal against the judgment and order dated 28.07.2023.

The explanation rendered in the application is that a copy of the order was received by the appellant only on 27.10.2023 by way of registered post from the learned Standing Counsel appointed by the Tirupati Municipal Corporation.

It was urged that the delay is neither intentional nor deliberate inasmuch as the applicant would not gain anything for filing the appeal late.

We have gone through the application as also heard learned counsel for the parties.

We find that sufficient cause has been shown for getting the delay condoned.

Accordingly, the application is allowed and the delay is condoned.

List the appeal for consideration on 19.02.2024.
