The Court made the following:

This appeal is filed under Section 100 of C.P.C against the

Decree and Judgment in A.S.No.20 of 1997 dated 22.01.2002 on

the file of VI Additional District Judge,(Fast Track Court) Chittoor,

confirmed the decree and Judgment in O.S.No.241 of 1992 on

the file of Principal District Munsif, Chittoor dated 04.01.1997.

02. As the learned counsel appearing for appellant gave up

vaalat, this Court directed the Registry to issue notice to

appellants. Notice issued to appellant Nos.2 to 5 are served.

Notice sent to appellant Nos.3 and 4 returned with endorsement

'addressee died' and notice returned to sender. As the appellants

are not showing interest to prosecute the appeal, this Court

posted the matter under the caption 'for dismissal'. Despite

posting under such caption, none appeared on behalf of

appellants. It seems appellants have no interest to proceeding

with the appeal. In these facts of the case, this Court has no other

option rather than to dismiss the appeal.

03. In the result, the Second Appeal is dismissed for default.

No order as to costs.

Consequently, miscellaneous petitions if any, stand closed.
