               CRIMINAL PETITION No.5193 of 2024

ORDER:

This Criminal Petition, under Section 482 of BNSS, is filed

seeking to enlarge the petitioner/A.1 on anticipatory bail in Crime

No.316 of 2024 of Muvvalavanipalem Police Station,

Visakhapatnam Commissionerate registered for the offences

punishable under Sections 318(2), 351(2), 127(2), 329(4) and 79

read with 3(5) of BNS and Sections 3(1)(r), 3(1)(s) and 3(2)(va) of

the Scheduled Castes and the Scheduled Tribes (Prevention of

Atrocities) Act, 1989.

2. Heard Sri R.Leela Sai Sampath, the learned counsel for

petitioner and the learned Assistant Public Prosecutor for

respondent- State

3. The learned Assistant Public Prosecutor for respondent-

State submits that notice was served to the victim-cum-de facto

complainant. None entered appearance.

4. Perused the record.

5. Since it is seen that the offences alleged are punishable

with seven years or less than seven years, the respondent-State

is directed to comply with the mandate in Section 35(3) of BNSS

and all the directions given by the Hon'ble Supreme Court of India

in the judgment in Arnesh Kumar v. State of Bihar1 and other

related rulings.

6. Accordingly, this Criminal Petition is disposed of.
