The Court made the following
ORDER:
Heard the learned counsel for the petitioners/At & Ad.
Perused the record.
This application is filled under Section JO7(1) of CrP.C, seeking
suspension of sentence and release the pefitionera/Ai & Ag on hall.
Both Courts below concurrently found the netitionars/AT & Ac
guilty for the offence punishable under Sections 420 and 468 read with
34 of the Indian Penal Code. .
The fearned counsel for the petitioners/At & A? submits that in
ebedience to the judgment of the Appellate Cour, the petitioners/Al &
A are now in prison serving the sentence.
Since the revision and its disposal would take some fime, and afer
considering the submissions, this petition is allowed, suspending the
sentence passed by the learned il Additional Sessions Judge, Kakinada,
in Criminal Appeal No.15 of 2020, dated 05.07 2024. The petitioners/Al &
A? shall be released on bail on thelr executing personal bond for a sum
of Rs.10,000/- (Rupees Ten Thousand only} each with two sureties for a
{ike sum each, to the satisfaction of the learned IV Additional Judicial
First Class Magistrate-cum-lV Additional Junior Civil Judge, Kakinada.
