The Court made the following:

Assailing the proceedings issued by the Joint Commissioner of Labour, Visakhapatnam dated 13.08.2024 (Ex.P11), the above writ petition is filed.

Learned counsel for the petitioner would submit that while issuing proceedings impugned, no show-cause notice was issued to the petitioner. He also would submit that the procedure adopted by respondent No.3 is contrary to the law declared in judgment of Aurangabad Municipal Corporation through its Commissioner & Others v. Jayant1.

(2021) 14 SCC 725 Learned Assistant Government Pleader for Services seeks time to get instructions.

List the matter on 27.08.2024 in the Motion List.

Till such time, the respondent authorities are directed not to take any coercive steps pursuant to the proceedings issued by the Joint Commissioner of Labour, Visakhapatnam dated 13.08.2024 (Ex.P11).
