The Court made the following:

JUDGMENT:

1. Today when the matter is taken up for hearing,

learned counsel representing on behalf of appellants represented that he had

addressed a letter to the appellant Nos. 2, 4 and 6 by issuing the Registered Notice and the same was returned with an endorsement "addressee

deceased". He further represented that he has no instructions from the other

appellants and requested to pass necessary orders. The representation made

by the learned counsel for the appellants is recorded.

2. Therefore, the Appeal Suit is dismissed for default. There shall be no

order as to costs.

As a sequel, miscellaneous petitions, if any pending, shall stand closed.
