The Court made the following Order:

This writ petition is filed under Article 226 of Constitution of India seeking the following relief:

"...issue an order or direction more particularly one in the nature writ of mandamus declaring the illegal action of the respondents in resorting to recover 1% labour cess from the petitioners contract work vide agreement No.3/EPC/2006-07 dated 23.04.2007 without revising the estimate as illegal, arbitrary, violative of Art 14, 19(1)(g) and 300-A of Constitution of India and contrary to the judgment in W.P.No.11269 of 2009 and batch dated 22.10.09, consequently direct the respondents to reimburse the labour cess recovered from the petitioners contract work vide agreement No.3/EPC/2006-07, dated 23.04.2007 so far by revising the estimates and pass..."

02. Sri T.Kumara Ratnam, learned counsel representing the learned counsel for the petitioner is present.

03. On written instructions dated 12.07.2024 of the 3rd respondent, the learned Assistant Government Pleader for Civil Supplies submitted that the revised final bill No.2022-1476308 was approved and payment was made on 18.03.2023 to the petitioner and thus, no further orders are required.

04. In view of the payment of the revised bill, the writ petition is closed.

No costs.

Interim orders granted earlier, if any, shall stand vacated.

Pending miscellaneous applications, if any, shall stand closed.
