Today, when the matter is taken up,
Sri Siddharth Luthra, learned Senior Counsel
appearing on behalf of the petitioner, as well as
Sri S. Sriram, learned Advocate General, would
state that SLP (Crl.) No.12289 of 2023 preferred
by the petitioner before the Hon'ble Supreme
Court against dismissal of quash petition filed in
relation to another crime, was reserved for
orders.
As the issue raised in the aforesaid
S.L.P. as regards applicability of Section 17-A of
the Prevention of Corruption Act, 1988, would
also fall for consideration in the present criminal
petition, learned Senior Counsel appearing on
behalf of the petitioner prays for taking up this
matter after Dussehra Vacation, 2023, awaiting
judgment to be passed by the Hon'ble Supreme
Court in the said S.L.P.
Learned Special Public Prosecutor, on
instructions, reports no objection to take up this
matter after the decision of the Hon'ble Supreme
Court.
Both sides would pray for taking up this
matter on 07.11.2023.
As prayed for, post on 07.11.2023.
Till then, interim order passed earlier in
this criminal petition is extended.
