Learned counsel for the appellant submits that this appeal is filed under Section 28 of the Hindu Marriage Act, 1955 challenging the judgment passed by the Senior Civil Judge, Mangalagiri, having jurisdiction of the Family Court.
2. If the judgment has been passed as, the Family Court, learned counsel for the appellant to address as to how the appeal is maintainable under Section 28 of the Hindu Marriage Act. And then whether the appeal would be maintainable under Section 19 of the Family Court Act or not.
3. If the appeal is under Section 19 of the Family Court Act, what period of limitation would apply as for appeals under Section 19 of the Family Court Act, the period of limitation is 30 days, whereas under Section 28 of the Hindu Marriage Act, the period of limitation is 90 days.
4. The Office, to submit report by 16.10.2023 on the above aspects as also under which provision of law the Registry has admitted the appeal.
