Criminal Petition No.7642 of 2023
ORDER:
The present application is filed by petitioners/A.1 and A.2 in Cr.No.10 of 2023
of Owk Police Station, Nandyal District, under Section 438 of Criminal Procedure
Code, 1973, seeking to grant anticipatory bail to them. The above crime was
registered against the petitioners for the offence punishable under Section 420 of IPC.
2. As seen from the record, the offence alleged against the petitioners is under
Section 420 of IPC, which is punishable with imprisonment of seven years or less than
the seven years. Therefore, the present case is squarely covered by the judgment of
the Hon'ble Supreme Court in 'Arnesh Kumar vs. State of Bihar1'.
3. Learned Assistant Public Prosecutor, on instructions, states that the police
have already issued notice to the petitioners under Section 41-A of Cr.P.C.
4. In that view of the matter, the criminal petition is disposed of, directing the
Station House Officer, Owk Police Station, Nandyal District to follow the procedure
prescribed under Section 41-A of Cr.P.C., and also the guidelines prescribed by the
Hon'ble Supreme Court in Arnesh Kumar's case.
