At the time of hearing, learned Assistant Public Prosecutor on instructions, submitted that due to stay granted by this Court at the inception, trial could not be completed. In view of the judgment of the Hon'ble Supreme Court of India in Asian Resurfacing of Road Agency Private Limited and Another v. Central Bureau of Investigation (2018) 16 SCC 299, stay is automatically vacated after six months and the same is not in force. The trial Court is directed to proceed with the trial expeditiously in accordance with Law and conclude on or before 12.12.2023.

Learned Assistant Public Prosecutor is directed to inform the same to the concerned.

Post the matter on 12.12.2023.
