Heard Sri L.Veera Reddy, learned Senior Counsel for petitioners / appellants and Sri C.Subodh, learned counsel for respondents.
Learned Senior Counsel would submit that the suit was decreed on 28.08.2023 for recovery of possession, granting two months time from the date of judgment i.e., 28.08.2023 and therefore, by this time, time granted by the trial Court is expired, and if the respondents file execution petition for delivery of the property, it will lead to multiplicity of the proceedings, and therefore, (Contd.,) ::2::
during pending appeal, stay may be granted to avoid multiplicity of proceedings. Learned counsel for respondents requested time to file counter.
Considering the above circumstances, interim stay of judgment and decree in O.S.54/2011 on the file of learned I Addl.District Judge, Chittoor, is granted for two (02) weeks.
