THE HON'BLE SRI JUSTICE RAVI NATH TILHARI
WRIT PETITION No.13240 OF 2023
JUDGMENT:
1. Heard Sri N. Prem Raj, learned counsel for the petitioner,
learned Government Pleader for Municipal Administration and
Urban Development Authority for the respondent Nos.1 and 2, Sri
K. Srinivasulu Reddy, learned counsel for the 3rd respondent and
Sri Kalava Suresh Kumar Reddy, learned standing counsel for the
respondents 4 and 5.
2. This writ petition has been filed for a direction to the
respondents, who are preparing proposed master plan for central
park, on the ground that the petitioners have not been given any
prior notice whereas the petitioners' land may also get affected in
such proposed master plan.
3. From perusal of the endorsement, being Roc.1568/2023/G1
dated 15.04.2023 by the Assistant City Planner, Municipal
Corporation, Anantapur, it is evident that new master plan is being
prepared by 3rd respondent. It is, however, clearly mentioned in
the endorsement dated 15.04.2023 that the proposed master plan
is to be published and detailed information will be provided after
completion of the entire process.
4. Consequently, the apprehension expressed by the petitioner
is unfounded. The submission that any prior notice has not been
given is also unacceptable as in view of the endorsement on
completion of the process of proposed Master Plan the same shall
be published.
5. In view of the aforesaid, the writ petition is dismissed at this
stage. No order as to costs.
Consequently, the miscellaneous petitions, if any, pending in
the petition shall stand closed.
