WRIT PETITION No.13348 OF 2023
JUDGMENT:
1. Heard Sri K.V. Aditya Chowdary, learned counsel for the
petitioner, learned Government Pleader for Municipal
Administration and Urban Development Authority for the 1st
respondent and Sri G. Naresh Kumar, learned counsel
representing Sri M. Manohar Reddy, learned standing counsel for
the respondents 2 and 3.
2. This writ petition has been filed for a direction to the
respondents 1, 2 and 3 and to cancel the building permission
granted to the 4th respondent vide building permission dated
26.10.2019 and to demolish the structure in view of the reports
dated 14.12.2022 submitted by the 2nd respondent in pending
W.P.Nos.25253 of 2020, 3532 of 2021 and 535 of 2021.
3. Challenging the same permission the same petitioner has
filed the aforesaid writ petitions which are pending. In those writ
petitions, this Court vide order dated 06.09.2021 directed to
complete the enquiry and submit the report. Pursuant to which
the report has been submitted in the said writ petitions. Basing
upon the said report this petition has been filed for the same relief.
4. In the considered view of this Court once the previous writ
petition, is pending with respect to the same subject matter, with
same prayer, by the same petitioner, and the report has been
submitted pursuant to the orders passed in those petitions, the
present writ petition is not maintainable.
5. Accordingly, the writ petition is dismissed. No order as to
costs.
Consequently, the miscellaneous petitions, if any, pending in
the petition shall stand closed.
