HIGH COURT OF ANDHRA PRADESH AT AMARAVATI
MAIN CASE NO.: C.R.P.No.1310 of 2023
PROCEEDING SHEET
Sl. DATE ORDER OFFICE
No. NOTE
CMR, J.
1) 12.05.2023 Issue notice to the respondent.
Learned counsel for the petitioner is permitted to
take out personal notice to the respondent by
registered post with acknowledgement due and file
proof of service in the Registry.
List the matter after Summer Vacation, 2023.
I.A.No.1 of 2023
Heard learned counsel for the petitioner. The
Suit is now at the stage of commencing the evidence
of defendant after closure of the evidence of plaintiff.
The two applications filed by the respondent, who is
the defendant in the Suit, for summoning certain
documents from the Sub-Registrar Office and from
the office of the Superintendent of Police, are
dismissed, by the impugned orders.
So, in the said facts and circumstances of the
case, instead of ordering stay of all further
proceedings, that stay of pronouncement of judgment
would be suffice, while allowing the trial to go on.
Therefore, there shall be a direction to the
learned Principal Senior Civil Judge, Kakinada, not to
pronounce the judgment in O.S.No.82 of 2021, until
further orders, while allowing the Court to proceed
with the trial of the Suit.
