JUDGMENT:
Appellants filed memo, vide U.S.R.No.48067 of 2023,
stating that they have settled the matter at the intervention of
elders and got registered the Partition Deed, vide Doc.No.12015
of 2022, dated 04.11.2022, and copy of the same is placed on
record. Further sought to dismiss the appeal as settled out of
Court.
2. In view of the above, the appeal is liable to be dismissed.
3. The learned counsel for the appellants further submits
that he filed I.A.No.4 of 2023 seeking return of documents,
which are filed in trial Court. In view of the disposal of the
appeal, the learned counsel is directed to obtain those
documents from the trial Court, by filing appropriate
application, as per law.
4. Thereby, I.A.No.4 of 2013 is dismissed.
5. Registry is directed to prepare the decree within fifteen
(15) days from the date of this judgment and thereafter return
the material papers to the trial Court immediately.
6. With the above observations, the appeal is also dismissed
as withdrawn. There shall be no order as to costs.
7. Interim orders granted earlier if any, stand vacated.
8. Miscellaneous applications pending if any, shall stand
closed.
