                     I have heard learned counsel for the
               petitioner/R3-insurance    company     as    well    as
               learned counsel for the respondents / claimants /

appellants. This petition is filed by the petitioner - insurance company to condone the delay of 89 days in filing the cross-objections in MACMA No.48 of 2019, which was filed by the claimants seeking enhancement of compensation. Now, the contention of the petitioner-insurance company is that they filed cross-objections questioning the quantum of compensation and other grounds which they raised in the cross-objections have to be Contd....

considered by the Court. The reason for delay in filing cross-objections is that they received grounds of appeal on 27.02.2019 about filing of MACMA and thereafter they secured required documents and then filed cross-objections, due to administrative constraints, delay occurred.

After considering the contention of learned counsel for the petitioner - insurance company, the delay in filing cross-objections is condoned on condition that the petitioner-insurance company shall deposit a sum of Rs.50,000/-(Rupees fifty thousand only) towards part of compensation amount before the Tribunal within 30 days from today, otherwise, the petition shall stand dismissed without reference to the Court.
