Heard the learned counsel for the
petitioner.
The learned Government Pleader for
Revenue takes notice for the respondents Nos.1
to 5.
The learned counsel for the petitioner is permitted to take out personal notice to the 6th respondent and proof of service shall be filed within a period of three (03) weeks from today.
The apprehension of the writ petitioner is that, the 5th respondent may entertain the document for registration at the instance of the 6th respondent. But already there is an interim order in I.A.No.1 of 2022 in S.A.No.748 of 2006 dated 31.01.2023 wherein, the petitioner and the 6th respondent are the parties to the said proceedings. The petitioner also relies upon the judgment of the Telangana High Court in W.P.Nos.26137, 22303, 26207 & 26236 of 2019 dated 23.01.2020. According to which, the Sub-Registrar cannot entertain the registration
of the document in the said circumstances.
The petitioner is at liberty to bring it to the notice of the 5th respondent about the orders of the Courts as stated above by enclosing the same along with the representation to the 5th respondent for consideration.
List the matter after Summer vacation, 2023.
In the meanwhile, the official respondents shall file their counters.
