At the time of hearing, learned Assistant Public Prosecutor submitted that after complete of investigation Charge Sheet is filed but the trial Court returned the Charge Sheet due to the stay granted by this Court earlier In view of the judgment of the Hon'ble Supreme Court of India in Asian Resurfacing of Road Agency Private Limited and Another v. Central Bureau of Investigation (2018) 16 SCC 299, stay is not in force. The concerned Station House Officer is directed to file charge sheet and proceed with the matter in accordance with law.

Post the matter on 14.06.2023.
