                APPEAL SUIT No.435 of 2008

JUDGMENT:

When the matter was called on 07.03.2023, there was no

representation on either side. The matter was posted on this

day i.e., on 16.03.2023 under the caption "for dismissal".

2. There is no representation on either side even today, as

the appellant does not appear to be interested in prosecuting the

appeal.

3. Hence, the appeal is dismissed for non-prosecution. There

shall be no order as to costs.

4. Consequently, miscellaneous petitions, if any pending, in

this appeal, shall stand closed.
