The petitioner/Accused is found guilty for the offence punishable under Section 304- A, 338 and 337 IPC, convicted and sentenced to undergo rigorous imprisonment for a period of two years and to pay fine amount of Rs.10,000/- and in default of payment of fine to undergo simple imprisonment for a period of three months for the offence under Section 304-A IPC, further convicted and sentenced to undergo rigorous imprisonment for a period of six months and to pay fine amount of Rs.1000/- and in default of payment of fine to undergo BSB, J Crl.R.C.No.173 of 2023

SL. DATE ORDER OFFICE NO. NOTE simple imprisonment for a period of one month for the offence under Section 338 IPC and further convicted and sentenced to undergo simple imprisonment for a period of one month and to pay fine amount of Rs.500/- and in default of payment of fine to undergo simple imprisonment for a period of seven days for the offence under Section 337 IPC and all the sentences shall run concurrently, vide judgment, dated 23.02.2017, in C.C.No.280 of 2008 on the file of the Court of Additional Judicial Magistrate of I Class, Gudur.

                   The        sentence     imposed     on      the
             petitioner/accused     is     confirmed   by     first
             appellate   Court,     vide     judgment,       dated

19.01.2023, in Criminal Appeal No.114 of 2017 of the learned VII Additional Sessions Judge, Gudur.

Heard learned counsel for the petitioner/Accused and learned Assistant Public Prosecutor appearing for the respondent

- State. Perused the material record.

Learned counsel for the petitioner submits that in view of the grounds urged in the revision, the petitioner has got fair chances of success in the revision.

Having regard to the facts & submissions BSB, J Crl.R.C.No.173 of 2023

SL. DATE ORDER OFFICE NO. NOTE and the issues raised in the grounds of revision, which require detailed examination, the substantive sentence of imprisonment alone imposed against the petitioner is suspended, pending final disposal of the revision, and the petitioner on surrender before the learned Additional Judicial Magistrate of I Class, Gudur within a period of three weeks from today, shall be enlarged on bail on his executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties in a like sum each to the satisfaction of the learned Additional Judicial Magistrate of I Class, Gudur.
