The petitioner/Accused is found guilty for the offence punishable under Section 138 of Negotiable Instruments Act, convicted and sentenced to undergo simple imprisonment for a period of two years and to pay a fine of Rs.4,00,000/- (Rupees four lakhs only) and in default of payment of fine to undergo simple imprisonment for a period of three months, vide judgment, dated 12.10.2018, in C.C.No.418 of 2017 on the file of the Court of Judicial Magistrate of First Class, Tiruvuru.

The sentence imposed on the petitioner/accused is confirmed by first appellate Court, vide judgment, dated 17.11.2021, in Criminal Appeal No.361 of 2018 of the learned XV Additional District and Sessions Judge, Krishna District at Nuzvid.

The petitioner is in Sub-jail, Nuzvid on confirmation of conviction in the appeal.

Heard learned counsel for the petitioner/Accused and the learned Assistant Public Prosecutor appearing for the 1st respondent - State.

Ms S.Gowthami, learned counsel filed vakalat for R- 2/complainant.

Sri T.V.Jaggi Reddy, learned counsel for the petitioner and Sri K.Diwakar, learned counsel representing Ms S.Gowthami, learned counsel appearing for R-2 represented that the matter was settled for payment of amount and transfer of property. It is further represented that necessary applications are contemplated to be filed soon to get the BSB, J Crl.R.C.No.200 of 2023

SL. DATE ORDER OFFICE NO. NOTE compromise recorded. The respondent No.2/complainant is present and duly identified. He stated about the compromise and receipt of the amount.

Having regard to the facts & submissions and the issues raised in the grounds of revision, which require detailed examination, the substantive sentence of imprisonment alone imposed against the petitioner is suspended, pending final disposal of the revision, and the petitioner, on surrender before the learned Judicial Magistrate of First Class, Tiruvuru, Krishna District, within a period of three weeks from today, shall be enlarged on bail on her executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum each to the satisfaction of the learned Judicial Magistrate of First Class, Tiruvuru, Krishna District
