Today, Sri Samuel Sanjay, learned counsel made appearance for the 5th respondent and represented that he has filed Vakalat into the Registry.

Learned counsel for the appellant represents that the present appeal is pertaining to the Judgment in O.S.No.30 of 2012 and along with O.S.No.30 of 2012, O.S.No.76 of 2014 were also disposed by the same Judgment, dated 23.12.2022 and insofar as the Judgment O.S.No.76 of 2014 is concerned, an appeal in A.S.No.316 of 2023 is pending before the Hon'ble Division Bench. He further submits that as th e Judgment is common, this appeal is to be listed before the Division Bench. Under the circumstances, the Registry is directed to look into the issue and to take appropriate steps, if necessary by placing a note before the Hon'ble the Acting Chief Justice.
