JUDGMENT:

Learned counsel for appellant is present. As seen from the

proceeding sheet the appeal against Respondent No.1 is

dismissed for default vide Order dated 13.04.2017 and

Respondent Nos.2 to 4 are shown as not necessary parties.

02. In view of the dismissal of the appeal against Respondent

No.1, appeal does not survive as it deemed to be dismissed on

13.04.2017.

03. Accordingly, the appeal is dismissed for default. There

shall be no order as to costs.

04. Miscellaneous petitions pending, if any, in this appeal

shall stand closed.
