The present Appeal Suit is directed against the Order and Decree

dated 10.12.2019 passed by the III Additional District Judge, Tirupathi,

Chittoor District, in E.A.No.58 of 2016 in E.P.No.17 of 2014 in O.S.No.10 of

2009.

2. The appellant has filed I.A.No.1 of 2023 seeking permission of the

Court to withdraw the Appeal Suit.

3. Permission, as sought for, is accorded.

4. I.A.No.1 of 2023 is, accordingly, allowed and the Appeal Suit is

dismissed as withdrawn. No costs. Other pending miscellaneous applications,

if any, shall also stand dismissed as withdrawn.
