                Writ Petition No.953 of 2023

ORDER:

Heard learned counsel for the petitioner, learned

Government pleader for Education for respondent Nos.1 to

4 and learned Government Pleader for respondent Nos.5 to

6.

This Writ Petition is filed for implementation of orders

dated 16.05.2019 passed in O.A.No.793 of 2019 by the

Andhra Pradesh Administrative Tribunal.

Learned counsel for the petitioner relies upon the

judgment in W.P.No.16921 of 2020 wherein the Division

Bench of this Court which directed enforcement of the

order passed by the Tribunal. Since the Tribunal is not

functioning at a point of time, learned counsel points out

that the order was passed for non implementation of the

order passed in O.A.No.835 of 2019 which is the part of the

batch matters including the O.A.No.793 of 2019. Therefore,

he states that there was discrimination in this case.

In all fairness, both the learned counsel for

respondents agree that a number of orders were passed by

the co-ordinate Division Bench of this Court holding that a

writ could be issued to implement the orders of the

Administrative Tribunal. Admittedly, no further

proceedings were taken against the orders dated

16.05.2019 also and they have become final.

Hence, the writ petition is allowed directing the

respondents to implement the order dated 16.05.2019 in

O.A.No.793 of 2019 within a period of eight (08) weeks

from the date of receipt of a copy of this order. There shall

be no order as to costs.

As a sequel, Miscellaneous Applications, if any,

pending shall also stand dismissed.
