                   WRIT PETITION NO.3428 OF 2023


ORDER:

The present writ petition is filed under Article 226 of the

Constitution of India seeking following relief:

"to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondent authorities with regard to non-payment of minimum pay scale to the writ petitioners attached to the post of Junior Lineman, CBD Gangman (Pole to Pole worker), Shift operator in the category of Junior Engineer, Junior Lineman, Watchmen in the place of watchmen by declaring that petitioners are discharging the same duties as that of Junior Lineman and issue consequential direction to pay minimum scale of pay to the writ petitioners as per the law laid down in State of Punjab and others vs. Jagjit Singh and others reported in 2017 (1) SCC 148 and pass such other order or orders.."

Heard Sri Sudhakar Reddy Pasapala, learned counsel for the

petitioners, Sri Anup Koushik Karvadi, learned Standing Counsel for

respondent No.2 and Sri V.R.Reddy Kovvuri, learned Standing

Counsel for respondent No.3. Perused the material available on

record.

Learned counsel for petitioners submits that the petitioners

submitted a representation dated 06.01.2023 to the respondent

authorities requesting for payment of minimum pay scale. He further

submits that suffice if a direction is given to the respondent

authorities to dispose of the representation dated 06.01.2023 in view

of the law laid down by the Hon'ble Apex Court in State of Punjab and others v. Jagjit Singh and others1, for payment of minimum

pay scale to the petitioners, by stipulating the time period.

Learned Standing Counsel for the respondent Nos. 2 and 3 does

not refute the said submission.

Having regard to the facts and circumstances of the case and

without touching the merits of the case, the petitioners are at liberty

to submit appropriate representations to all the concerned authorities

for redressal of their grievances within a period of two(02) weeks from

the date of receipt of a copy of this Order. On receipt of such

representations, the same be examined and appropriate orders be

passed by the authorities concerned strictly in accordance with law,

within a period of six (06) weeks, thereafter. It is also made clear that

the petitioners are entitled to place on record the relevant judgments,

if any, for consideration of the same by the authorities concerned.

With the above directions, the Writ Petition is disposed of. There

shall be no order as to costs.

As a sequel miscellaneous application, pending, if any, shall also

stand closed.
