No DATE Note 05 28.02.2023 DVSS, J & SV,J Arguments of the learned counsel for the petitioner and the learned counsel for the unofficial respondents were completed. Relying upon the Division Bench Judgment of this Court reported in 2006(1) APLJ 447 and the provisions of Hindu Minority and Guardianship Act, 1956, which according to the learned counsel has overreaching affect, the learned counsel for the petitioner submits that the husband is the natural guardian even for a minor married girl.
The learned counsel for the unofficial respondents also submits that the parents of the girl have already expired and her grandfather alone is alive and he is suffering from old age related ailments. Despite his old age he is willing to look after the child.
In these circumstances, to ascertain the intention of the girl Mrs.Bhavana, the 4th respondent is directed to produce the girl before this Court along with a proper escort.
