This petition has been filed seeking to enlarge red to I/O the petitioners on bail pending the present Criminal folder Appeal. before correcti on Vide judgment dated 28.11.2019 in NDPS S.C. No.6 of 2013 on the file of the I Additional District and Sessions Judge, Chittoor, the petitioners/ A.1 and A.2 were convicted of the offence punishable under Section 8 (c) read with 20 (b) (ii) (C) of the NDPS Act and sentenced to undergo rigorous imprisonment for a period of ten years and to pay fine of Rs.1,00,000/- each in default to suffer rigorous imprisonment for a further period of six months each.

It is stated that on 12.02.2023, the petitioner No.2/A.2 complained chest pain radiating to (Lt) shoulder and (lt) hand with sweatings, and the Jail Medical Officer examined him and referred to Casuality Government General Hospital, Kadapa on the same day for further treatment, from where he was referred to higher centers like SVIMS Hospital, Tirupati/ GGH, Kurnool for further investigations and management. It is further stated that the jail authorities sent him to Holystic Hospital, Kadapa on 13.02.2023 for Arogya Sri basis, Kadapa where angiogram was done and it was diagnosed as a CAD-evolved AWMI,moderate LV dysfunctio with LVEF-38 CAD-CAD-TVD and treated him as an inpatient for 5 days and advised him Coronary Artery Bypass Graft.

It is further stated that the jail authorities sent him to SVIMS, Tirupati on 18.02.2023 for further management, and he was admitted in SVIMS, Tirupati on 18.02.2023 as inpatient and treated and planned for CABG.

On instructions, the learned Special Assistant Public Prosecutor submitted that petitioner No.2/A.2 has to undergo by-pass surgery. He produced copy of the Medical Certificate sent by the Superintendent of Jails, Central Prison, Kadapa.

In view of the same and as petitioner No.1/A.1, being his son, has to attend to the needs of his father, this Court feels that they can be enlarged on bail, pending disposal of the Criminal Appeal.

Accordingly, the petition is allowed. The petitioners shall be enlarged on bail on executing a personal bond for a sum of Rs.25,000/- (Rupees twenty five thousand only) each, with two sureties each for the like sum, to the satisfaction of the I Additional District and Sessions Judge, Chittoor. Petitioner No.1/A.1 shall attend before the Station House Officer concerned once in a month till disposal of the Criminal Appeal. It is needless to mention that the petitioners have to be present before this Court on the date of hearing of the Criminal Appeal.
