For the reasons stated in the accompanying affidavit filed in support of the petition, the delay of 17 days in re-submitted the criminal appeal is condoned. I.A.No.1 of 2023 is ordered accordingly.

I.A.No.2 of 2023 Present petition is filed by the petitioner/appellant/ sole accused in SC No.5 of 2021 on the file of the Special Judge for trial of cases under POCSO Act, Srikakulam, seeking his release on bail, pending Crl.A.No.576 of 2023.

By way of judgment dated 10.11.2022, the learned Special Sessions Judge, convicted the appellant for the offence punishable under Section 363 IPC and sentenced to undergo simple imprisonment for a period of six months. The learned Special Sessions Judge further convicted the appellant for the offence punishable under Section 376AB IPC and sentenced to undergo rigorous imprisonment for a period of twenty (20) years and the appellant was further convicted for the offence punishable under Section 506(ii) IPC and sentenced to undergo simple imprisonment for a period of six months.

This Court perused the material on record. By order dated 05.12.2022, earlier application filed by the petitioner i.e., I.A.No.1 of 2022, which was filed seeking his release on bail pending criminal appeal was dismissed as withdrawn.

Again, the petitioner/appellant filed the present application i.e., I.A. No.2 of 2023 seeking his release on bail pending criminal appeal before this Court. As the appellant was convicted for the offence punishable under Section 376 AB IPC and he was sentenced to undergo rigorous imprisonment for a period of 20 years, this Court does not find any reason to enlarge the petitioner on bail pending criminal appeal, at this stage.

Accordingly, I.A.No.2 of 2023 is dismissed.
