Heard the learned senior counsel appearing for the petitioner/appellant. There is some in the contention that the execution petition can be filed and attachment can be ordered without notice, since the date of decree is only 28.12.2022. Since it is a money decree, there shall be stay of all further proceedings pursuant to the judgment and decree in OS No.48 of 2015 dated 28.12.2022 on the file the V Additional District Judge, Tirupati, within a period of eight (8) weeks from today, on the condition that,
(a) the petitioner/appellant shall deposit 50% of the decretal amount along with the accrued interest thereon to the credit of the suit in the trial court;
(b) in addition, the petitioner/appellant shall also deposits the entire costs that are awarded to the credit of the suit in the trial court, and
(c) it is made clear that, if the amounts are not deposited as directed above, the interim stay should stands vacated automatically, without reference to the Court.
