JUDGMENT:

1. When the matter is taken up for hearing in the afternoon session

at 03.30 PM, Sri P.V.Mahesh, learned counsel appeared on

behalf of the appellant and submits that he filed a memo vide

U.S.R.No.104616 of 2022 that the subject matter is covered by

the Lok Adalat Award in O.S.No.204 of 2005 dated 08.02.2020

and requested to close the Appeal.

2. Recording the submissions made by the learned counsel for the

appellant and on perusal of the memo and in view of the

compromise attained between the parties, this Court is inclined

to permit the appellant to withdraw the appeal.

3. In the result, the appeal is dismissed as withdrawn. No costs.

4. Miscellaneous petitions pending, if any, in this appeal shall

stand closed.
