I have heard both sides.
The learned counsel for
respondent/claimant would submit that
they have no objection for condoning the delay in preferring an appeal, as they also preferred separate appeal with delay condonation, which was allowed by this Court. For the reasons stated in the affidavit of the petitioner, the delay of 178 days in preferring appeal against the decree and judgment in M.V.O.P. No.166 of 2014 is hereby condoned.

The learned counsel for the petitioner/claimant would submit that this Court already permitted to withdraw 50% of the amount deposited by respondent Corporation as per orders in M.A.C.M.A. No.3601 of 2017 and M.A.C.M.A. No.1996 of 2017 dated 17.08.2017 and accordingly petitioner have already withdrawn the amount which deposited by the respondent
Corporation. Hence, this petition is closed.
