Sri K.Rathanga Pani Reddy, learned counsel for the petitioner submits that by impugned notice dated 5.5.2021, the petitioner has been directed to pay the enhanced rent for the previous lease period ie., retrospectively, where as this Court in WP.No.19228 and batch of petitions of 2020 vide judgment dated 8.12.2020, inter alia held that the Municipality cannot levy rent with retrospective effect more so without the tenants' consent.

Sri M.Manohar Reddy, learned Standing Counsel, for the Respondent No.2 prays for four weeks time to file counter affidavit.

If counter is filed, the reply/joinder affidavit, if any, may also be filed within a period of two weeks.

List on 24.11.2022 along with WP.Nos.21700 of 2021, 13550 of 2021, 11564 of 2022 and 19228 of 2020 as prayed for.

Learned counsel for the petitioner submits that the same controversy is attracting the attention of the Court in WP.No.28388 of 2022 and the batch matters and accordingly, list on 24.11.2022 along with WP.No.28388 of 2022 and the connected matters.

Till the next date of listing, the impugned notice dated 21.12.2021 shall remain stayed.
