WRIT PETITION No.5451 of 2022
JUDGMENT:-
Heard Sri Devi Prasanna Kumar, learned counsel,
appearing for the O.M.R Law Firm.
Learned counsel for the petitioners submits that the
petitioners may be permitted to withdraw the writ petition with
liberty to file fresh writ petition.
The petitioners' counsel has submitted a letter dated
29.09.2022
to the Registrar Judicial of this Court for withdrawal
of the writ petition, based on the instructions received from the
petitioners vide letter dated 29.09.2022 addressed to their
learned counsel which has been annexed with the application
for withdrawal.
A perusal of the letter dated 29.09.2022 shows that the
petitioners only requested their learned counsel to withdraw the
writ petition and did not request nor instructed him for liberty
to file fresh writ petition.
The last part of the petitioners' letter addressed to their
counsel is as under:-
"Hence, we request our advocate to kindly withdraw the above writ petition No.5451/2022 pending before the Hon'ble High Court of A.P. Amaravathi and same mention the allotted shop numbers in the withdrawal petition."
In view of the aforesaid, the petitioners are permitted to
withdraw the writ petition.
The writ petition is dismissed as withdrawn.
However, the request of the petitioners' counsel to grant
liberty to file fresh writ petition, in the circumstances mentioned
above, is rejected.
No order as to costs.
As a sequel thereto, miscellaneous petitions, if any
pending, shall also stand closed.
