This petition is filed by the petitioners/appellants under Section 5 of the Limitation Act requesting to condone the delay of 6951 days in filing the appeal against the decree and judgment dated 10.08.2021 in LAOP.No.19 of 1991 on the file of Additional Senior Civil Judge, Gudur.

Heard learned counsel for the petitioners and learned Assistant Government Pleader for Appeals.

Learned counsel for the petitioners submits that the petitioners are poor agriculturists whose lands were compulsorily acquired by the Government for the Irrigation SL. DATE ORDER OFFICE NO. NOTE Project and their livelihood is agriculture and they were dispossessed from the land. He further submits that due to illiteracy, the petitioners could not prefer the appeal within time and hence requested this Court to condone the delay by imposing costs.

He brought to the notice of this Court, in similar circumstances, vide order dated 25.06.2019 in IA.No.2 of 2019 in LAAS.No.108 of 2019 this Court condoned the delay in filing the appeal.

Learned Assistant Government Pleader for Appeals has not disputed the order dated 25.06.2019 in IA.No.2 of 2019 in LAAS.No.108 of 2019, and states that the present interlocutory application may be considered on its merits.

Considering the submissions made by the learned counsel, in the interests of justice, this Court felt it appropriate to condone the delay on costs.

Accordingly, the delay of 6951 days in filing the appeal is condoned on payment of costs of Rs.10,000/-, out of which 50% has to be paid to the Andhra Pradesh High Court Legal Services Committee and remaining 50% to the learned Assistant Government Pleader for Appeals within a period of four weeks from SL. DATE ORDER OFFICE NO. NOTE today.
