ORAL JUDGMENT Dt: 24.11.2022 (per Prashant Kumar Mishra, CJ)

This writ appeal is directed against an interim order dated 11.06.2018

passed by the learned single Judge in I.A.No.1 of 2018 in W.P.No.15501 of

2018. The said I.A. was filed by appellant herein/writ petitioner seeking a

direction to the 3rd and 4th respondents therein to grant interim custody of

tractor bearing No.AP-02-X-1488 to the appellant/writ petitioner, pending

disposal of the writ petition. By the order under appeal, the learned single

Judge granted interim direction as prayed for subject to the appellant/writ

petitioner paying an amount of Rs.75,000/- (Rupees Seventy Five Thousand

only) in favour of the 3rd respondent within a period of two weeks from the

date of order.

2. Today, at the hearing, learned counsel for the parties would submit

that similar orders were passed in all such matters relating to seizure of

vehicles allegedly involved in illegal transportation of sand. Learned

Government Pleader for Mines & Geology would submit that now those

matters have been decided keeping in view the provisions of G.O.Ms.No.71

dated 04.09.2019 issued by the Government.

3. In the circumstances, learned counsel for the parties would agree that

it would suffice if the main writ petition is heard and decided at an early date.

4. In view of the above, without interfering with the interim order under

appeal, we close this writ appeal with a direction to the registry to list the writ

petition - W.P.No.15501 of 2018 in the next week before the single Bench

concerned and, upon such listing, the main writ petition may be heard and

decided at the earliest.

5. As a sequel, pending miscellaneous applications, if any, shall stand

closed. No costs.
