HIGH COURT OF ANDHRA PRADESH AT AMARAVATI
MAIN CASE No.: W.P.No.41265 of 2022
PROCEEDING SHEET
Sl.
ORDER
No DATE
1. 22.12.2022 DR, J
The present Writ Petition is filed
questioning the orders of the 3rd respondent
dated 08.12.2022.
The contention of the learned counsel for
the petitioner is that the orders passed by the
3rd respondent on 08.12.2022 is contrary to
the observations made of this Court in catena
of Judgments, wherein this Court has held that
the revenue authorities have no jurisdiction to
entertain in the matters of Grama kantam.
In the instant case, where back in the
year 1986, the respondents have given
assignment patta to the petitioner for an extent
of Ac.0.02 ½ cents situated in Sy.No.1013 of
Chennada Village, Razole Mandal, Ambedkar
Konaseema District. Since then, the petitioner
is in continuous possession of the subject
property. Now, without cancelling the said
patta granted in favour of the petitioner, the
respondents have passed the impugned orders
which is illegal and arbitrary.
Considering the submissions of the
learned counsel for the petitioner and on
perusal of the records, the proceedings of the
3rd respondent dated 08.12.2022 are
suspended on the ground that the 3rd
respondent has no jurisdiction to deal with the
matters. Further, the notice issued by the 4th
respondent dated 12.12.2022 is also
suspended, pending further orders.
Post after Pongal Vacation, 2023.
