JUDGMENT:(per A.V. Sesha Sai, J)

       Heard Sri A.Sai Rohit, learned counsel for the writ

petitioner   and Sri G.Vijay Kumar,        learned Standing

Counsel for the respondent-University of Medical Sciences.

Inaction of the respondents, in considering the candidature

of the petitioner for admission into MBBS course under

NCC Quota in SV local region, is under challenge in the

present Writ Petition.

Obviously, on the ground that the petitioner did not

get qualified in accordance with Note (1) of Para 3 of

G.O.Ms.No.123 of the Health, Medical and Family Welfare

(C1) Department dated 24.07.2017, the respondent-

University refused to give admission to the petitioner.

The Government of Andhra Pradesh, pursuant to the

orders of the composite High Court of Andhra Pradesh dated

13.07.2016 in W.P.No.26478 and batch, issued instructions in

the matter of priorities to be adopted for admission into MBBS

and BDS courses for 1% reserved for NCC in the State of Andha

Pradesh vide G.O.Ms.No.109 of Health, Medical and Family

Welfare (C1) Department dated 18.08.2016. An amendment

came to be made to Note (1) of Para 3 of the said Governmental

Order which reads as follows:

"Priority will be considered in 'C' 'B' & 'A' certificates

obtained prior to appearing in qualifying examination i.e., 10+2

examination."

Admittedly, the petitioner herein did not get the certificate

prior to the qualifying examination. Therefore, this Court finds

no merit in the Writ Petition. Accordingly, Writ Petition is

dismissed. There shall no order as to costs.

Miscellaneous petitions, if any, pending in this case, shall

stand closed.
