Appeal Suit No.1191 of 2018
JUDGMENT:
Learned counsel appearing for the respondents is present and submitted
that I.A.No.1 of 2019 was filed by him reporting that the sole defendant died on
23.10.2018, leaving behind two sons as legal representatives and steps have not
been taken till filing of the application on 17.12.2019. Notice was given to the
learned counsel for the respondent/appellant.
2. On 27.07.2022, when the matter was called, Sri C.Panini Somayaji,
learned counsel, who appeared for the appellant, represented that the party had
taken away the bundle and stated that no objection certificate had not been
taken by the party and therefore they would inform their client about the next
date of adjournment. On 24.08.2022, there was no representation for the
respondent/appellant and thus, the matter has been adjourned to 26.08.2022.
Today also, there is no representation for the appellant.
3. In spite of informing the Court and also to the learned counsel for the
appellant about the death of the appellant by filing an affidavit on a specific
date, no steps have been taken to bring the legal representatives on record.
Therefore, the appeal got abated.
4. Accordingly, the Appeal is closed. There shall be no order as to costs.
5. Miscellaneous petitions pending, if any, shall stand closed.
