                        Nobody appears on behalf of the appellant.
                        2.   Mr.     S.   Dushyanth    Reddy,     learned
                Additional Public Prosecutor for the State, is
                present.
                        3. The Court would note that on written
                memo filed by learned counsel for the appellant
                seeking withdrawal, the matter has been listed
                today under the caption "For Withdrawal".
                        4. However, it transpires that the Criminal
                Appeal is directed against the judgment of
                acquittal, dated 17.11.2020 in Sessions Case
                No.105 of 2015 passed by the learned III
                Additional District and Sessions Judge, Nellore
                against the respondents no.2 to 5, who were

accused nos.1 to 4, wherein A-1 to A-3 were charged for the offences punishable under Section 120-B read with Sections 302 and 364 I.P.C., A-1, A-2 and A-4 were charged for the offences punishable under Sections 109 and 364 I.P.C., A-1, A-2 and A-4 were charged for the offence punishable under Section 364 I.P.C., A-1 and A-2 were charged for the offence punishable under Section 302 I.P.C., and A-1 and A-2 were charged for the offences punishable under Section 201 read with Section 302 I.P.C.

5. Having regard to the fact that upon hearing, the Court had issued notice in the matter, which indicates that prima facie, a case for interference has been made out and now, petition being filed seeking withdrawal, this Court deems it appropriate that the learned counsel for the appellant should be present before the Court.

6. Accordingly, by way of indulgence, the matter be listed on 04.05.2022.
