                    WRIT PETITION No.20870 OF 2021

ORDER:

This Writ Petition is filed under Article 226 of the Constitution

of India, seeking the following relief:

".....to issue a Writ, Order or direction more particularly one in the nature of Writ of mandamus declaring the action of the 2nd respondent in not disposing of petitioners applications under section 22-A(1)(A) applications dated 03.07.2020 is illegal, arbitrary unconstitutional and consequently direct the 2nd respondent to consider and dispose of the petitioners applications vide the 1st petitioner application on 03.07.2020 vide application No TTA012000052999 relating to Sy.No.36/1 of an extent of Ac.0.64 Cents situated in Peddipalem Village, Anandapuram Mandal, Visakhapatnam District, 2nd petitioner application dated 03.07.2020 vide application No TTA012000052996 of petitioners lands relating to Sy.Nos. 36/2, 36/3, 37/3, 38/1 and 38/2 of an extent of Ac 2.15 Cents situated in Peddipalem Village, Anandapuram Mandal, Visakhapatnam District and 3rd petitioner application dated 03.07.2020 vide application No TTA012000052998 of their lands relating to Sy.No.36/ 1 of an extent of Ac 0.22 Cents situated in Peddipalem Village, Anandapuram Mandal, Visakhapatnam District according to law and pass such other orders...".

2. Though the petitioners made several allegations against the

respondents, during hearing, learned counsel for the petitioners

limited his request to dispose of the On-line Applications Nos.

TTA012000052999, TTA012000052996 and TTA012000052998,

dated 03.07.2020 submitted by the petitioners, without touching the

merits of the case.

3. Learned Assistant Government Pleader for Revenue

appearing for respondents readily agreed to dispose of the On-line

Applications Nos. TTA012000052999, TTA012000052996 and

TTA012000052998, dated 03.07.2020 submitted by the petitioners, if

any, pending with the respondent authorities.

4. Recording the submissions of the learned Government

Pleader for Revenue, I need not decide the truth or otherwise of the

allegations made in the petition. This Court is conscious that no such

direction be issued, in view of the judgment of the Apex Court in "The

Government of India v. P.Venkatesh1", wherein the Apex Court held

that such orders may make for a quick or easy disposal of cases in

overburdened adjudicatory institutions. But they do not serve to the

cause of justice. As the learned counsel for the petitioners himself

requested to issue a direction to dispose of the On-line Applications

Nos. TTA012000052999, TTA012000052996 and TTA012000052998,

dated 03.07.2020 submitted by the petitioners, I find no other

alternative, except to issue such direction.

5. In the result, the Writ Petition is disposed of, directing the

respondent authorities to dispose of the On-line Applications Nos.

TTA012000052999, TTA012000052996 and TTA012000052998,

dated 03.07.2020 submitted by the petitioners, in accordance with

law, within four (04) weeks from today. No costs.

As a sequel, miscellaneous application, pending, if any, shall

also stand closed.
