Learned counsel for the appellant, apart from making submissions with reference to the claim of the appellant for enhancement of the compensation, places reliance on 2011 ACJ 1 (Raj Kumar Vs. Ajay Kumar and others), 2021 SCC Online (SC) 850 (Chandra @ Chanda @ Chandraram Vs. Mukesh Kumar Yadav), 2020 ACJ 2695 (Pappu Deo Yadav Vs. Naresh Kumar and others), and 2020 (11) SCC 356 (National Insurance Company Limited Vs. Birender and others).
Learned standing counsel for respondent No.2-Insurance Company, on the other hand, submits that the amount as awarded by the Claims Tribunal is just, reasonable and warrants no interference by this Court. He further submits that once a claim is made under Section 163-A of the M.V. Act, it is not open to the claimants to seek more compensation by referring to Section 166 of the said Act. He accordingly submits that the appeal may be dismissed.
