Since the following substantial questions of law arise for determination in the second appeal, ADMIT.

1. Whether the lower appellate court is justified in partly allowing A.S.No.9 of 2012 with costs by setting aside the judgment and decree dated 23.02.2012 in O.S.No.61 of 1999?

2. Whether the suit is bad for non-joinder of necessary parties as held by the lower appellate court or Appeal Suit stood abated on account of death of 3rd defendant/appellant during the pendency of the Appeal Suit?
