ORAL JUDGMENT

Dt: 21.10.2021

(Prashant Kumar Mishra, CJ)

This writ appeal is preferred against an order dated 08.03.2021 passed by the

learned single Judge in W.P.No.5513 of 2021.

2. The issue brought before the learned single Judge in the writ petition was

concerning fixation of pension, retirement gratuity, encashment of earned leave and

other benefits. The claim of the writ petitioner was based upon an order dated

29.01.2021 passed in W.P.No.870 of 2021. Having found that the case of the writ

petitioner is similar to the one decided in W.P.No.870 of 2021, learned single Judge

has allowed the writ petition in the same terms.

3. In the course of hearing, Mr. Y.N. Vivekananda, learned Govt. Pleader

attached to the office of the learned Additional Advocate General-II, appearing for HCJ & CPK,J

the appellants, failed to satisfy this Court that W.P.No.5513 of 2021 is not similar to

the one decided earlier, i.e. W.P.No.870 of 2021. If that be so, there is no substance

in the writ appeal.

4. Accordingly, the writ appeal is dismissed. No order as to costs. Pending

miscellaneous applications, if any, shall stand closed.
