              WRIT PETITION No.23025 of 2021


ORDER:-

      The petitioner is presently working as Anganwadi Helper

in Ravinuthala Village, Korisapadu Mandal, Prakasam District.

The post of Anganwadi Worker notified for recruitment by the 5th

respondent.

      2.    It is the case of the petitioner that according to the

extant Rules and Memos, the Anganwadi Helpers should be

given precedents for appointment to such post and in any event,

the said post should be treated as a promotional post to

Anganwadi Helpers in view of the Judgment of a learned Single

Judge of the High Court of judicature at Hyderabad for the State

of Telangana and the State of Andhra Pradesh dated 16.11.2015

in W.P.No.31374 of 2015 and batch. She submits that the said

post cannot be filled up by any other person unless and until

she is found to be ineligible for the said post. She would further

contend that even though these posts are shown to be reserved

for S.T and B.C-A community, her candidature should be

considered even though she is belonging to the O.C community

as it is a case of promotion and reservation cannot apply to

such promotions.

      3.    In view of the directions in W.P.No.31374 of 2015

and batch, dated 16.11.2015, this writ petition is disposed of

with direction to the respondents to consider the case of the

petitioner along with all other applicants in accordance with the

memos issued in this regard and more specifically Memo

No.16037/15/2018-1 dated 13.12.2018, circular instructions

issued under Memo No.9207/ICDSA1/98, dated 23.12.1998,

Memo No.5771/K3/2006 dated 03.12.2010 provided she is

found eligible. There shall be no order as to costs.

             As a sequel, pending miscellaneous petitions, if any,

shall stand closed.
