JUDGMENT:- (Per Hon'ble Sri Justice C.Praveen Kumar)


       Heard Sri P.S.P.Suresh Kumar, learned counsel appearing

for appellant/husband and Sri J.Krishna Praneeth, learned

counsel appearing for respondent/wife.

2. Originally the appellant has filed O.P.No.296 of 2008 seeking

dissolution of marriage on the ground of cruelty. By its judgment

dated 08.12.2011, the Family Court-cum-IV Additional District

and Sessions Judge at Vijayawada dismissed the said O.P.

Assailing the same, the present appeal came to be filed. Pending

appeal, I.A.No.1 of 2021 is filed along with joint memo of

compromise dated 28.09.2021 seeking dissolution of marriage by

mutual consent.

3. Today, when the matter is taken up, Sri Chagantipati

Nagaraju/appellant-husband and Smt.Chagantipati Neelima

Devi/respondent-wife are present before the Court and they are

identified by their respective counsel. When examined,

Smt.Chagantipati Neelima Devi/respondent-wife stated that she

has settled all the disputes with her husband and no objection for

granting divorce by mutual consent. Sri Chagantipati

Nagaraju/appellant-husband also submits that he has no

objection for granting divorce by mutual consent.

4. A perusal of the joint memo shows that there is no

possibility of reconciliation or reunion of both parties. At the

instance of elders, both the parties have decided to take divorce by

mutual consent and they have consented for the same. It appears

that since 2007 both the parties are living separately. It is also

stated by both the parties that the terms of joint memo have been

acted upon.

5. Having regard to the above and making the terms of

compromise as part of the order, I.A.No.1 of 2021 is allowed

granting divorce by mutual consent. Consequently, the Family

Court Appeal is also allowed. There shall be no order as to costs.

Miscellaneous petitions pending, if any, in this Family Court

Appeal shall stand closed.
