            CIVIL REVISION PETITION No.1243 of 2021

ORDER:

The petitioner herein is the plaintiff in O.S.No.35 of 2014

in the Court of the Junior Civil Judge, Pakala. This suit was

filed for an injunction restraining the respondents herein from

interfering with the peaceful possession and enjoyment of the

suit schedule property which is Ac.2.00 cents of land in

Sy.No.276/2 of Kallur Village, Pulicherla Mandal, Chittor

District.

2. This suit was dismissed on 04.10.2018. Thereafter,

the petitioner had filed A.S.No.144 of 2018 in the Court of the IX

Additional District Judge, Chittoor against the said Judgment

and decree. Along with this appeal, the petitioner would also file

I.A.No.105 of 2018, for an injunction, pending disposal of the

appeal. This application has not been considered nor have

orders been passed in this application for the past three years.

Aggrieved by the said non disposal of the application, the

petitioner has approached this Court.

3. The non disposal of an interlocutory application for

more than three years especially an application for injunction is

not conducive for the administration of justice or an appropriate

manner of dealing with such application.

4. In the circumstances, this Civil Revision petition is

allowed directing the IX Additional District Judge, Chittoor to

consider and dispose of I.A.No.105 of 2018 at the earliest and

not later than two months from the date of receipt of this order.

There shall be no order as to costs.

As a sequel, the miscellaneous applications, if any

pending, shall stand closed.
